ACROSS THE WILD TOURS AND SAFARIS BOOKING TERMS AND CONDITIONS POLICY
These terms and conditions govern the contractual relationship between Across the Wild Tours and Safaris Ltd (hereinafter referred to as “the Agency”) and the client (hereinafter referred to as “the Client”) for all tours and travel services provided by the Agency. The information presented in this policy is correct to the best of our knowledge at the time of publication. However, changes beyond our control may occur with respect to prices, itineraries, duration of holidays, and the standard of services.
1. Booking Policy and Payment
- To confirm a booking, a commitment fee of 30% deposit is required at the time of booking.
- Full payment for the tour package must be made 30 days prior to the commencement of the tour.
- Payment can be made via TT bank to bank wire transfer or online credit card payment.
- Reservations made less than 29 days prior to the start of the tour require 100% payment.
- International bank charges are applicable and will be deducted from the amount sent. These charges typically range from $20 to $35 for TT wire transfers.
- Credit card payments incur a bank surcharge of 4% of the amount sent, which goes directly to the bank.
- The guest/client is responsible for all bank fees associated with payments via bank transfer or online credit card.
2. Cancellation Policy
In the event of cancellation, the following policies apply:
a) Cancellations from the time of committing with a deposit to 60 days prior to the commencement of the tour are subject to a cancellation fee of 10% of the total tour cost.
b) Cancellations made within 59 days to 30 days prior to the commencement of the tour are subject to a cancellation fee of 30% of the total tour cost.
c) Cancellations made within 29 days to 15 days prior to the commencement of the tour are subject to a cancellation fee of 75% of the total tour cost.
d) Cancellations made within 14 days prior to the commencement of the tour are subject to a 100% cancellation fee of the total tour cost.
- Travelers should always be covered by cancellation insurance in case of force majeure. Force majeure includes (but is not limited to) war, threat of war, riot, civil disobedience or strife, industrial dispute, terrorist activity, acts of God, natural or nuclear disaster, fire, adverse weather conditions, level of water, closure of airports, or any unforeseeable or unavoidable event beyond Across the Wild Tours and Safaris’ control.
- If force majeure occurs in the country of origin, the traveler should cancel the tour. Similarly, if such events occur in the destination country, Across the Wild Tours and Safaris will cancel the tour at least 14 days prior to arrival after assessing the situation.
- The accommodating property and Across The Wild Tours and Safaris will not be liable for any eventuality experienced as a result of force majeure during the tour period.
3. Postponement
- If it is necessary to postpone your trip, notify us in writing at least 14 days in advance.
- Once hotel reservation fees are paid in full, there shall be no refund. However, the reservation shall be left open on credit to be utilized within a period of one year.
4. Changes to Itinerary
- The Agency reserves the right to modify the itinerary of the tour due to unforeseen circumstances, including but not limited to natural disasters, political unrest, or safety concerns.
- In the event of itinerary changes initiated by the Agency, reasonable efforts will be made to provide alternative arrangements of equal or higher value.
5. Travel Insurance
- The Client is strongly advised to obtain comprehensive travel
- insurance covering trip cancellation, medical emergencies, and other unforeseen events.
- Across The Wild Tours and Safaris shall not be liable for any losses incurred by the Client due to the lack of adequate travel insurance coverage.
6. Liability
- Across The Wild Tours and Safaris acts only as an agent for transportation companies, hotels, and other suppliers of services connected with the tour. Whilst Across the
- Wild Tours and Safaris will always subcontract the best of all such facilities, it shall not be liable for any shortfall experienced as a result of such subcontracting.
- The Client agrees to release the Agency from any liability arising from acts of third parties, including but not limited to hotels and park authorities.
7. Refund
- Across The Wild Tours and Safaris shall refund to their clients all the money or part of the payment submitted by the client for services not provided as a result of negligence or any other shortcoming on the part of Across the Wild Tours and Safaris.
8. Governing Law and Jurisdiction
- These terms and conditions shall be governed by and construed in accordance with the laws of Kenya.
- Any disputes arising from or related to these terms and conditions shall be subject to the exclusive jurisdiction of the courts of Kenya.
